This program will examine the causes of gender and racial wage gaps, including pay discrimination, occupational segregation, and implicit bias. Panelists will address trends in equal pay-related litigation, including the distinction between anti-discrimination versus equal pay claims. Can employers rely on prior salary to justify pay disparities under federal or state equal pay laws? What particular issues arise in equal pay cases within the legal profession? The panel will also discuss settlement considerations and trends in legislation, including pay transparency requirements; limits on employer inquiries into and reliance on prior salary; and narrowing employer defenses. Finally, the program will examine proactive measures taken by employers to discover and remedy pay disparities and promote gender and racial equity.
